Orma — Terms of Service

By using Orma you accept these Terms. They are written in plain language but form a contract between you and Orma.

1. The service

Orma helps you report and find lost, found or abandoned animals, supports adoptions from shelters, rescues and private individuals, lets you keep your pets' health record with its reminders, and lets you report dangers to animals (suspicious baits, snares, glass and others) and suspected mistreatment. With the morning walk it shows you every day the dangers and lost animals near your area, a weather estimate, a seasonal tip and a true story. It is a COMMUNITY tool: the information comes from users, it is not verified one by one, and we guarantee neither its accuracy nor any outcome. Orma is run by Nicholas Iacoviello (an individual, Italy) — info@orma.pet, PEC info@pec.orma.pet.

2. Your account

You are responsible for the truthfulness of the information you publish, for the confidentiality of your credentials and for all activity carried out through your account. You can close your account whenever you want, from your profile.

3. Rules of conduct

When you use Orma you undertake to:

tell the truth: false, invented or alarmist reports are forbidden;
report a PLACE, an animal or a situation, NEVER to accuse or name a person;
not publish photos in which people, faces, number plates or other people's data are recognisable;
answer “Still there?” only for a place you have actually been past, saying what you saw; not use several accounts, or team up with others, to confirm or remove a danger or to earn points;
in adoption listings, give the animal's real microchip number (required for dogs, cats and ferrets offered for adoption by private individuals), and declare the veterinary health certificate only if there is one;
in a story you propose to us, tell true facts of your own, without data that make other people identifiable (surnames, faces, number plates), phone numbers, IBANs, links or fundraising;
put up the Orma sign only where it is allowed;
not use the service to insult, threaten, defame, spam or extort, nor for illegal activity;
publishing, requesting or sharing child sexual abuse or exploitation material (CSAE), or content that puts minors at risk, is strictly prohibited: it is removed and reported to the competent authorities.

Content that breaks these rules may be removed, points earned by breaking them may be cancelled, and accounts that abuse the service may be suspended. The numbers and the authorities to contact in your country are on the “Rules in your country” page.

4. Danger reports and the authorities

Reports of dangers (suspicious baits, snares, glass and the other types), mistreatment and abandonment are a warning between users and do NOT replace a report to the authorities: publishing one on Orma is not a criminal complaint, does not start any statutory time limit running and does not open any proceedings. In an emergency, or where a criminal offence is involved, contact the official channels of your country yourself; you will find them on the “Rules in your country” page.

A reported danger is what the person reporting it saw, not an established fact: nobody has analysed the bait or checked the place. It stays on the map for a time that depends on its type; passers-by can confirm it or say it is no longer there, and two “No, not anymore” answers from different people remove it. If a danger is not on the map, that does not mean there is none on the spot.

The file for the authorities (Italy only) is your own document: you prepare it on your phone, you sign it and you send it yourself to the authority you choose. Orma does not receive it, does not forward it and does not check its content; until you send it, it is neither a criminal complaint nor a formal notice. You answer for what you write in it, as for any report.

Whoever publishes a report answers for what they write. A report that is false, or created to cause panic or to harm people or businesses, may amount to a criminal offence and give rise to an obligation to compensate the damage, under the law of the country where it takes place.

Orma cooperates with the authorities in the cases provided for by law and complies with the orders issued by them. Private mistreatment reports remain private and do not appear on the public map; where needed, we forward them to the competent authority.

5. Illegal content and removal

Under Regulation (EU) 2022/2065 (Digital Services Act) you can report any content that is illegal or contrary to these Terms using the "Report" button available on content in the app, or by writing to info@orma.pet. The report must give reasons and indicate where the content is. Our single point of contact, for users and authorities alike, is info@orma.pet (languages: Italian and English). We assess reports and remove illegal content that we become aware of.

6. Rewards

Any rewards shown in reports are decided by users and handled directly between them. Orma does not promise them, does not act as an intermediary for them, does not guarantee them and does not hold any sums.

In several countries whoever finds an animal is entitled by law to something: in some, a percentage of its value; in others, reimbursement of the expenses incurred. We do not set out the figures here because they change from country to country: you will find what we know on the “Rules in your country” page.

One thing holds everywhere: keeping the animal in order to obtain money is the worst move. In some countries it means losing both the right to the reward and the possibility of becoming the owner of the animal, and it may amount to a criminal offence.

7. No guarantee of recovery

Orma is a tool that HELPS to find or adopt animals, but it is not a search, recovery or rescue service and it does not promise a result. We cannot ensure that an animal will be found, recognised or returned, nor that a report will reach the right people: that depends on who reads it and on who happens to be nearby, not on us.

This does not reduce what Orma owes you as a service: that is dealt with in the section WHAT ORMA IS LIABLE FOR.

8. Moderation, suspension and closure

We may moderate, remove or hide content that breaks these Terms or the law, and we may limit, suspend or close an account in cases of abuse, well-founded reports or safety risks. Where reasonable we will try to inform you, but in urgent cases we may act immediately. You can stop using Orma at any time and delete your account (Profile → Delete account).

9. Content and ownership

You keep ownership of the photos and texts you upload and grant us a free, non-exclusive licence limited to displaying them so that the service can work: in the app, in notifications and on the orma.pet pages that open from shared links (for example a report's page). We publish a story you propose to us only with the consent you give in the form, and only as a morning story: in the app, on orma.pet and in the “Send a good morning” image, possibly shortened or translated; this licence ends when you withdraw the story, ask us to take it down or delete your account, but we cannot recall images already forwarded by others. You are solely responsible for the content you publish and you warrant that you have the right to publish it. The name "Orma", the logo and the software are protected by law; maps and third-party data (e.g. OpenStreetMap, Open-Meteo) remain the property of their respective owners.

10. What Orma is liable for

10.1 — What Orma is. Orma is a community noticeboard. The reports, the photos and the information about animals are published by users. Orma provides the tool for publishing them, searching them, filtering them on the map and getting in touch. Orma is not a search, recovery, rescue, veterinary, surveillance or investigation service, it does not conduct any inquiry into the facts reported and it does not carry out checks on the spot.

10.2 — What Orma undertakes to do. Orma undertakes to supply you with a service that is fit for the purposes for which a service of the same type would normally be used, and that possesses the qualities and performance features that are normal for a service of the same type and that you may reasonably expect, including in relation to functionality, compatibility, accessibility, continuity and security. Orma also undertakes to inform you of, and to supply you with, the updates that are necessary to keep the service in conformity, including security updates, for as long as the service is supplied to you.

10.3 — If the service does not work. If the service is not in conformity with what is described in point 10.2, write to info@orma.pet. Orma brings the service back into conformity within a reasonable time from the moment you informed it of the lack of conformity, free of charge to you and without any significant inconvenience to you. If Orma does not do so, or if the lack of conformity appears again, you may terminate the contract and close your account at any time, from your profile. Since the service is free of charge, you may do so even where the lack of conformity is only minor. All the other remedies to which you are entitled by law remain unaffected, including compensation for damage.

10.4 — Who has to prove what. If you claim that the service has not been supplied to you or that it is not in conformity, the burden of proving the contrary is on Orma, throughout the period during which the service is supplied to you. Orma can be discharged only by demonstrating that the cause lies in your digital environment — device, network or software — and only if it informed you of this in a clear and comprehensible manner before the conclusion of the contract. In that case we ask you for the cooperation that is reasonably possible in order to establish this, using the technically available means that are least intrusive for you.

10.5 — Content and conduct of other users. The content published on Orma comes from the users who publish it, and is attributable to them. Orma does not check it item by item before publication and removes it when it obtains actual knowledge that it is illegal or contrary to these Terms, as provided in the section ILLEGAL CONTENT AND REMOVAL. Meetings, handovers of the animal, rewards and adoptions are direct relationships between the users concerned, to which Orma is not a party.

10.6 — General rule. For everything that is not governed by the points above, Orma is liable in accordance with the law applicable under the section GOVERNING LAW AND COMPETENT COURT. These Terms do not contain, and are not intended to contain, any exclusion or limitation of Orma's liability.

11. Governing law and competent court

11.1 — If you use Orma as a consumer. If you use Orma for purposes which are outside your trade, business, craft or profession, these Terms are governed by the law of the country in which you have your habitual residence.

11.2 — Where you can bring proceedings. You may bring proceedings against Orma before the court for the place where you are domiciled, or before the Italian court. If it is Orma that brings proceedings against you, it may do so only before the court of the country in which you are domiciled.

11.3 — No waiver. No provision of these Terms deprives you of the protection afforded to you by the provisions of your country of residence that cannot be derogated from by agreement.

11.4 — Before going to court. If you have a problem you can write to info@orma.pet. We reply as soon as possible. This is not a condition for bringing court proceedings, it does not make you lose any time limit and it does not take away any of your rights.

13. Minimum age

To open an account you must be at least the minimum age required by the law of the country where you live. The app shows you the threshold for your country when you sign up: it ranges from 13 to 16, and in Italy it is 14 years of age.

When you register we ask you for the country where you live and your year of birth. We need them only in order to apply this threshold: we keep the country, the year you gave and the date on which you gave it, and we do not ask you for identity documents or any other proof.

If you declare an age below the threshold we cannot open the account, and we do not keep the data you had entered.

If we become aware that an account has been opened by someone who is not old enough, we close it and delete the data linked to it. If you are a parent, or hold parental responsibility, and you believe that an account has been opened by a minor, write to info@orma.pet: we check and, if that is the case, we close the account and delete the data.

Access to your device's location, the sending of notifications, the morning walk notification and the publication of a story you propose to us are asked of you separately and are not part of your acceptance of these Terms: you can grant them and withdraw them whenever you want.

14. Rules in your country

In many countries the law imposes its own obligations on whoever loses an animal, on whoever finds one and on whoever witnesses mistreatment: registers to enrol in, time limits within which to make a declaration, authorities to turn to. Orma does not replace any of these steps: a report published here is not a criminal complaint, is not an entry in a register and does not start any statutory time limit running.

On the “Rules in your country” page you will find an unofficial summary of what we know, with the date on which we checked it and the link to the source. It is a summary, not legal advice, and for some countries we have no verified rule to set out: in any event, the laws of your country prevail.

15. Information, estimates and tips

Orma gives you useful information, but it does not replace your vet or the authorities.

The vaccination plan, the “Can they eat it?” guide and the seasonal tips are general information, taken from the sources we cite: they are not an examination or a prescription. Your vet decides the dates of booster shots: the app does not calculate them.
The walk weather is an estimate, taken from Open-Meteo: it is not a guarantee.
The nearby dangers and lost animals are those that users have reported: the list is not a check of your route, and “no dangers reported” does not mean there are none.
Morning stories are told by the people who lived them: we choose them and may shorten or translate them, but we cannot verify every detail.

If you have any doubt about your pet's health, or if it has eaten something suspicious, call your vet straight away.

This does not reduce what Orma owes you as a service: that is dealt with in the section WHAT ORMA IS LIABLE FOR.

These Terms and the Privacy Policy are provided to you in the language you have chosen in the app. If a version were to contain a translation error, the interpretation most favourable to you prevails.
